1. Agreement to these Terms

These Terms of Service ("Terms") are a binding agreement between you and Gary Butler, doing business as Inchmeal ("Inchmeal", "we", "us", or "our"). They govern your use of inchmeal.app (the "Website") and the Inchmeal mobile app for iOS and Android (the "App", and together with the Website, the "Service").

By joining the waitlist, creating an account, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.


2. Who may use Inchmeal

You must be at least 18 years old to create an account or use the App. By using the Service, you confirm that you are 18 or older. If you use the Service on behalf of an organisation, you also confirm that you are authorised to accept these Terms for it.


3. What Inchmeal does

Inchmeal helps you break a task that feels too big into a small daily plan. You photograph or describe the thing you want to change; Inchmeal uses AI to produce a project name, a description of what "done" looks like, an optional generated image, and a set of small steps sorted into days. To close out a day, you show your progress with a new photo or a short note, and Inchmeal gives you a gentle read on how far along you are.

We may add, change, or remove features at any time. During early access and beta, the Service may be incomplete, may change significantly, and may occasionally be unavailable.


4. Inchmeal is not medical, health, or professional advice

This is important. Inchmeal is a productivity tool. It is not a medical device and does not diagnose, treat, cure, or prevent ADHD or any other condition, and it does not provide medical, psychological, therapeutic, legal, financial, or other professional advice. Nothing in the Service is a substitute for advice from a qualified professional. Never disregard or delay seeking professional advice because of something in Inchmeal. If you may be experiencing a medical or mental‑health emergency, contact your local emergency services.


5. AI‑generated content

Inchmeal's plans, generated images, and progress checks are produced by automated AI systems (see the Privacy Policy, Section 5, for how your input is processed by Google's Gemini models). AI output:

  • may be inaccurate, incomplete, or unsuitable for your situation;
  • is provided for your general assistance only; and
  • should be reviewed with your own judgement before you rely on it.

You are responsible for how you act on Inchmeal's suggestions. Do not rely on a progress check, plan, or generated image as a statement of fact.


6. Your accounts

You sign in through Google or Apple. You are responsible for keeping access to your sign‑in account secure and for activity that happens under your Inchmeal account. Tell us at hello@molehills.app if you believe your account has been used without your permission. Your use of Google and Apple sign‑in is also subject to their own terms.


7. Your content

You keep your content. As between you and us, you own the photos, notes, descriptions, and other material you put into the Service ("Your Content").

You grant us a limited licence. You grant Inchmeal a worldwide, non‑exclusive, royalty‑free licence to host, store, transmit, display, and process Your Content solely to operate and provide the Service to you — including sending it to our AI provider to generate plans, images, and progress checks. This licence exists only so the Service can work; it ends when you delete the content or your account, except for copies our providers process transiently and any copies we must keep to comply with law.

You are responsible for Your Content. You confirm that:

  • you have the rights needed to submit it;
  • it does not infringe anyone's rights or break any law; and
  • you have any consent needed from other people who appear in your photos.

Please don't submit the underlying private work itself (for example the full text of a document) when a short note about what changed will do — Inchmeal is designed not to need it.


8. Acceptable use

You agree not to:

  • use the Service for anything unlawful, harmful, or abusive;
  • upload content that is illegal, infringing, hateful, harassing, or that depicts another person without the consent you need — and never sexual content involving minors;
  • upload other people's private or confidential information without permission;
  • attempt to reverse‑engineer, scrape, overload, disrupt, or gain unauthorised access to the Service or its AI systems, or use it to build a competing model or dataset;
  • probe or bypass rate limits, security, or usage controls; or
  • misrepresent your identity or affiliation.

We may suspend or remove content or access that we reasonably believe breaks these Terms.


9. Early access and the waitlist

The Website currently collects a waitlist. Joining it does not guarantee access, pricing, timing, or that Inchmeal will launch at all. We will use your email only as described in the Privacy Policy. Early‑access and beta features are provided on an "as is" basis and may change or end at any time.


10. Subscriptions and billing

Inchmeal includes limited free use and offers auto-renewable monthly and annual subscriptions for additional access. The App shows the current price, billing period, and included features before you subscribe. Prices may vary by country, currency, taxes, and app store.

Payment is charged to your Apple App Store or Google Play account when you confirm the purchase. A subscription renews automatically unless you cancel it through your store account at least 24 hours before the end of the current billing period. The store may charge the renewal within 24 hours before that period ends. You can manage or cancel a subscription in your app-store account settings. Deleting your Inchmeal account or removing the App does not cancel a subscription. Refunds and billing disputes are handled under the applicable app store's rules. We may change subscription prices or features with the notice and consent required by the store and applicable law.


11. Our intellectual property

The Service — including the Inchmeal name, logo, design, text, and software (but not Your Content) — is owned by Inchmeal or its licensors and is protected by intellectual‑property laws. We grant you a personal, limited, non‑exclusive, non‑transferable, revocable licence to use the Service for its intended purpose under these Terms. You may not copy, modify, distribute, sell, or create derivative works from the Service except as these Terms allow.


12. Third‑party services and the app stores

The Service depends on third parties, including Google (AI and sign‑in), Apple (sign‑in and App Store services), RevenueCat (subscription management), and Google Play. Your use of those services is governed by their terms, and we are not responsible for them.

Apple‑specific terms. If you use the App on an Apple device, you acknowledge that these Terms are between you and Inchmeal only, not Apple; that Apple has no obligation to provide support for the App; and that Apple and its subsidiaries are third‑party beneficiaries of these Terms and may enforce them. Your use must comply with the Apple Media Services Terms and the Apple standard EULA. Similar terms apply to Google Play.


13. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory — including implied warranties of merchantability, fitness for a particular purpose, non‑infringement, and any warranty that the Service will be uninterrupted, secure, error‑free, or that AI output will be accurate. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.


14. Limitation of liability

To the fullest extent permitted by law:

  • Inchmeal and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill, arising from your use of (or inability to use) the Service; and
  • our total liability for all claims relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim, or US $100.

Nothing in these Terms limits liability that cannot be limited under applicable law (for example, for death or personal injury caused by negligence, or for fraud). If you are a consumer, you may have rights that these Terms do not override.


15. Indemnification

You agree to indemnify and hold harmless Inchmeal and its owners, employees, and suppliers from any claims, losses, and reasonable expenses (including legal fees) arising out of Your Content, your use of the Service, or your breach of these Terms or of anyone's rights.


16. Termination

You may stop using the Service at any time and close your account from Settings in the App. Account deletion does not cancel an app-store subscription. We may suspend or end your access if you break these Terms or if we reasonably need to protect the Service or other users. Sections that by their nature should survive termination (for example Sections 7, 13, 14, 15, and 18) will continue to apply.


17. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the "Last updated" date and, for material changes, give reasonable notice (for example by email or an in‑app notice). If you keep using the Service after an update takes effect, you accept the revised Terms.


18. Governing law and disputes

These Terms are governed by the laws of the State of Oklahoma, United States, without regard to its conflict-of-laws rules. You and Inchmeal agree to the exclusive jurisdiction of the state and federal courts located in Oklahoma for any dispute.

Nothing here removes mandatory consumer‑protection rights you have in your country of residence.


19. General

  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Service.
  • Severability. If any part is found unenforceable, the rest stays in effect.
  • No waiver. If we don't enforce a right, that isn't a waiver of it.
  • Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
